PENDING INVESTIGATIONS.
As we look back to the past, and forward to the future, our Firm continues to investigate present day events that could translate to spectacular legal battles.
Currently, some communities have contacted us in connection with gas flaring and oil spillages caused by powerful multinational oil companies and energy giants, which have derogated their environment, killed fauna and aquatic animals, and cause substantial hardship to their way of life. Losses are estimated at $2 billion or more. We are evaluating the various legal challenges posed by this claim, in addition to the trans-national comparative law issues, as well as the “legal-politics” dynamics. We anticipate that a favorable outcome will permit us to institute action on behalf of these communities.
In a separate matter, we are evaluating whether the designers, and manufacturers of a “sail containment system” used by construction companies to transport materials on bridges or high construction sites are liable for a near fatal injury of a construction foreman. Although there is reason to believe that defective design caused the “jamming” and sudden deceleration of the system along tracks on the truss, our experts are studying the design, calculations and structural data to determine defects. We anticipate a substantial recovery if negligence is established.
Further, we have been asked to evaluate the possibility of a malpractice in the case of a patient who died in his doctor’s office of “pulmonary embolism” after he was discharged from the emergency room. There is allegation that within 30 minutes after his death, the hospital doctors extracted his vital organs without the consent or authorization of his next of kin.
Not only these, our Firm continues to investigate the claims of a designated beneficiary against a National Insurance Company and the Employer of a decedent whose Life Insurance proceeds and “stock option” worth millions of dollars was paid to the wrong beneficiary. In matters such as these, investigators zero in on the articles of designation and the language of the policy to ultimately determine the chances of prevailing in an ERISA action.
